1.2. In addition to these terms and conditions, the legal relations arising from the marketing of products through the e-store are regulated by the laws of the Republic of Estonia.
1.4. Product selection, prices and discounts may differ from the product selection, prices and discounts of the Company’s partner retail stores.
2.1. The prices of the products are given on the product sheets and include the VAT valid in the Republic of Estonia.
2.2. The fee for the delivery method chosen by the Customer when placing the order is added to the price of the product. A delivery method is selected and the cost of delivery in the basket is calculated.
2.3. If there is a promotional code, the discount for the product is calculated after entering the discount code in the shopping cart.
2.5. The online store has the right to withdraw from the sale transaction and demand the return of the goods from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to a mistake.
3. PLACING AN ORDER
3.1. Having selected a product on the “PRODUCTS” page, the Customer adds it to his cart using the “ADD TO CART” button.
3.2. You can enter your cart using the “VIEW SHOPPING CART” button and remove items from the cart by clicking on the black cross at the beginning of the product line. You can also add products to your cart by clicking “UPDATE CART” or continue shopping by clicking “CONTINUE SHOPPING” until you pay for your order.
3.3. To place an order, click the “CHECKOUT” button in the shopping cart. In the checkout module, you must fill in the BILLING DATA on the left side of the page, select the delivery method on the right side of the page and select the parcel machine from which you want to receive the goods.
Then you need to choose the payment method that suits you.
3.4. You can pay by bank transfer, bank link or credit card through Paysera payment center. The payment method must be confirmed by pressing the white circle in front of the corresponding payment method.
3.5. To place an order, you must agree to the terms of the online store by checking the white box in front of the sentence “I have read and agree to the terms and conditions.
3.6. Then click the “ORDER” button and you will be redirected to the payment environment you selected earlier.
3.7. fter payment click in the banking module “RETURN TO THE SELLER”. Purchase completed.
3.8. In the absence of the Goods ordered by the Customer, the Company cancels the order. The order can be canceled in part or in full. The Customer will be immediately notified of the cancellation of the order. In the event of a partial cancellation, the Company may ask the Customer to wish to process the remainder of the order and send it or also cancel it.
4. PAYMENT INFORMATION
4.1. The Customer pays 100% prepayment for purchases made in the online environment (online store).
4.2. Orders can be paid by credit card (Visa, MasterCard) and links to Estonian banks (Swedbank, SEB, Luminor / Nordea, LHV Pank).
4.3. Payment takes place outside the online store in a secure environment. When paying by bank link in the secure environment of the respective bank and when paying by credit card in the secure environment of Pysera (https://paysera.com/). The company does not have access to the customer’s bank details and credit card.
4.4. After placing the order and paying for the goods, the Customer will be sent an order confirmation by e-mail. When the goods are delivered, an invoice will be added to the shipment.
5. TOODETE TOIMETAMINE KLIENDILE
5.1. The e-shop delivers products to Estonia, Latvia and the Republic of Lithuania.
5.2. The products are delivered to the customer as the services of Tähitud Maksikiri Ärikiri and Omniva pak parcel machine offered by Omniva (AS Eesti Post). Shipments can be tracked in the Omniva and UPU international tracking environment at www.track-trace.com/post.
5.3. The Customer shall pay the costs associated with the delivery of the Products. The shipping fee will appear in the e-shop environment by selecting the shipping method and the mail machine.
5.4. The company fulfills orders, that is, it delivers the order to the post office for shipment no later than 14 working days after the order is confirmed. Delivery of the goods to the Customer depends on the postal services. Estimated time of arrival:
* In Estonia: 1-20 business days
* Latvia, Lithuania: 2-20 business days
6. RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE OF PRODUCTS
6.1. The Customer has the right to cancel the transaction without giving any reason within 14 calendar days by submitting a written application to the Company, sending it by mail or digitally signed by e-mail.
6.2. The Company confirms receipt of the withdrawal request by sending a notification to the Customer.
6.3. The customer is obliged to return the product within 14 calendar days as of the submission of the withdrawal application. The withdrawal period is calculated from the day when the Customer or a third party appointed by him, who is not the carrier of the goods, has taken possession of the product. If the order consists of more than one shipment, the withdrawal period is calculated from the day the last parcel arrives at the Customer.
6.4. Upon withdrawal from the transaction, the Company returns the amounts paid by the Customer, including the fee for delivery of the product to the Customer, by transferring the returned amount to the Customer’s bank account no later than 14 days after the product reaches the Company. The Entrepreneur/Company has the right to delay the return of the paid amounts until the Customer has returned the product or submitted a certificate of handover to the post office for the return of the product. When exercising the right of withdrawal, the Customer shall bear all direct costs related to the return of the product.
6.5. If the Customer wishes to exchange, fix or replace the product, he must notify the Company in writing. In the event of an exchange or replacement of goods, the Customer bears all direct costs associated with the return of the goods if the returned goods do not correspond to those ordered.
6.6. The prerequisite for returning and exchanging the product is a completely unused product, which still has all the labels and other documents accompanying the shipment, including the invoice issued to the Customer.
6.7. For hygiene reasons, unpacked hygiene products and products with obvious signs of use are not eligible for return.
6.8. The Customer can replace the product within 14 days from the date of receipt. Registered Customers can exchange goods within 30 days.
6.9. If the product returned to the Company cannot be exchanged for the product requested by the Customer, the Company shall contact the Customer.
7. SUBMISSION OF A CLAIM
7.1. The Company shall be liable for non-compliance and defects of the products within 2 years from the receipt of the products by the Customer.
7.2. Upon discovery of non-conformity of the product or defects of the product, the Customer undertakes to notify the Company immediately, but not later than within 1 month of becoming aware of the non-conformity, by sending the relevant information to the e-mail address. email@example.com or in writing ELKEL OÜ, Rapla maakond, Kohila vald, Prillimäe alevik, Aia põik 1, 79702.
7.4. In the event of a non-conformity or defect in the product, the Customer has the right to first request a free replacement of the product for the relevant product or return the product at the Company’s expense. The Customer has the right to demand a reduction in the purchase price of the goods or the termination of the contract and the return of the amounts paid for the goods if:
- it is not possible for the Company to repair or replace the product, or
- the product fails to be repaired or replaced, or
- the company has not remedied the product defect within a reasonable time, or
- Unreasonable inconvenience is caused to the customer.
7.5. In the event of a return of a non-conforming product, the amount paid for it together with transportation costs shall be returned to the bank account specified by the Customer within 14 days. The Company has the right to postpone the refund of the amount paid until the Customer returns the goods to the Company or submits a certificate from the post office about the delivery of the goods for return.
7.6. The company does not reimburse the costs incurred by the Customer in the event of non-conformity or defects in the goods and is not responsible for them if:
- The value of the product has decreased / the product has been damaged due to the Customer’s fault;
- Disadvantages have arisen from the misuse of the product, i.e. as a result of non-compliance with the maintenance instructions;
- The value of the product has declined due to normal wear and tear caused by normal use;
- No documents confirming the purchase.
7.7. In case of disagreements between the Customer and the Company regarding defects of the product, the Customer has the right to file a claim with the Company, stating his name and contact details in the written or reproducible form (e-mail), the date of complaint, the product defect and your preferred solution. The Company shall respond to the Customer’s complaint in writing or in a form that can be reproduced in writing (e-mail) within 14 days. If the buyer has any complaints about the online store, they must be sent to the e-mail address
7.8. If the Customer and the Company do not reach an agreement on the dispute and if the value of the disputed product is at least 30 euros, the Customer has the right to apply to the Consumer Disputes Committee of the Estonian Consumer Protection Board for out-of-court settlement of the dispute.(www.komisjon.ee) and pan-European online dispute resolution within the European Union Online Dispute Resolution at http://ec.europa.eu/odr. In the Consumer Disputes Committee, the review of a complaint is free of charge for the parties. Disputes in Estonia at the Consumer Protection Board are governed by the laws of the Republic of Estonia.
7.9. In case of disagreement with the decision of the Commission, the parties have the right to apply to the county court of the location of the Company.
PROCESSING OF PERSONAL DATA
8.1. The data about the Customer and his orders stored in the e-store ordering environment is treated as confidential information. The company does not disclose the information it has become aware of to third parties.
8.2. Data transmission between the Customer and the banks, as well as the payment card center is encrypted, which ensures the security of the Customer’s personal data and bank details. The Company does not have access to the confidential bank details and the Customer’s payment cards.
8.3. The personal data submitted by the Customer to the Company upon making the purchase is protected and they are processed in accordance with the requirements of the Personal Data Protection Act.
Personal data is collected and processed for the following purposes:
- Purchase analyzes and summaries,
- To make offers to the customer,
- Customer satisfaction surveys.

8.5. ELKEL OÜ may authorize other legal persons to process personal data (authorized processor) provided that an agreement has been entered into with such processor, according to which the authorized processor is required to keep the processed personal data confidential and ensure personal data protection in accordance with law.
8.6. ELKEL OÜ makes the up-to-date list of legal entities available to the Client on the basis of the Client’s application submitted in writing to ELKEL OÜ, registry code 12768321, Rapla maakond, Kohila vald, Prillimäe alevik, Aia põik 1, 79702 or digitally signed at firstname.lastname@example.org.
